The woman who was attacked and severely injured by soldiers in Ikorodu, Lagos State, has sued the Nigerian Army and her attackers, Punchng reports.
She is, among other things, demanding N250m as damages. Ruth Orji was allegedly attacked by soldiers attached to 174 Battalion, Ikorodu, around 8:30pm on Sunday. .
Images of her, showing the injuries she sustained have gone viral on the social media, sparking outrage. And the Joint Legal Action Aids, the rights group representing her, is optimistic she will get justice in court. .
The General Counsel of the JLAA, Kingsley Ughe, confirmed that he filed the case on her behalf at a Federal High Court in Lagos. He added that the case was not the first the JLAA was instituting against the army in connection with soldiers brutalising civilians. .
He expressed the hope that beyond getting justice for the victims of military brutality, the cases would help check the rising cases of degradation of civilians.
When contacted, the Director, Army Public Relations, Brig. Gen. Sani Usman, said there were several disciplinary procedures in the army to deal with alleged human rights abuses, adding that the infractions would be investigated.
The National Agency for Food, Drug Administration and Control (NAFDAC) has been ordered to direct Nigeria Bottling Company (NBC) Plc., manufacturers of Fanta and Sprite soft drinks to add a warning on the bottles of the product, that its content cannot be taken with Vitamin C.
According to The Nation, Justice Adedayo Oyebanji, of the Lagos High Court, Igbosere gave the ordered following a suit filed by businessman Dr Emmanuel Fijabi Adebo and his firm, Fijabi Adebo Holdings Ltd.
The legal action instituted in 2008 had NBC and NAFDAC as defendants.
Fijabi’s lawyer, Abiodun Onidare told the court that his client bought large quantities of different products from NBS for export to the UK but when they arrived at their destination, Fanta and Sprite failed UK Health Authorities’ (Stockport Metropolitan Borough Council’s Trading Standards Department of Environment and Economy Directorate) sample test for human consumption, as they became poisonous when mixed with Ascorbic Acid (Vitamin C).
The claimants demanded N15, 119,619.37 as special damages and N1, 622,000 being the money the NBC admitted it received from the claimants.
In its defence, the NBC, through its lawyer, T. O. Busari, stated that it was not negligent as claimed by the plaintiff, adding that it has stringent quality control procedures to ensure that its products are safe for end-user consumption.
The NBC argued that the levels of the chemical components in its soft drinks are safe for consumption in Nigeria and that the claimants are not entitled to the recovery of damages arising from their illegal exportation of products meant for local distribution.
NAFDAC did not file any defence in the case.
Justice Oyebanji ruled:
It is imperative to state that the knowledge of the Nigeria Bottling Company that the products were to be exported is immaterial to its being fit for human consumption. The court is in absolute agreement with the learned counsel for the claimants that soft drinks manufactured by Nigeria Bottling Company ought to be fit for human consumption irrespective of colour or creed.
It is manifest that NAFDAC has been grossly irresponsible in its regulatory duties to the consumers of Fanta and Sprite manufactured by Nigeria Bottling Company. In my respective view, NAFDAC has failed the citizens of this great nation by its certification as satisfactory for human consumption, products which in the United Kingdom failed sample test for human consumption and which become poisonous in the presence of Ascorbic Acid ordinarily known as Vitamin C, which can be freely taken by the unsuspecting public with the company’s Fanta or Sprite.
As earlier stated, the court is in absolute agreement with the learned counsel for the claimants that consumable products ought to be fit for human consumption irrespective of race, colour or creed.
By its certification as satisfactory, Fanta and Sprite products manufactured by Nigeria bottling company without any written warning on the products that it cannot be taken with Vitamin C, NAFDAC would have by its grossly irresponsible and unacceptable action caused great harm to the health of the unsuspecting public.
The court, in the light of the damning evidence before it showing that NAFDAC has failed to live up to expectations, cannot close its eyes to the grievous implication of allowing the status quo to continue as it is.
For the reasons herein adumbrated in this judgement, the court hereby orders as follows:
“That NAFDAC shall forthwith mandate Nigeria Bottling Company to, within 90 days hereof, include on all the bottles of Fanta and Sprite soft drinks manufactured by the company, a written warning that the content of the said bottles of Fanta and Sprite soft drinks cannot be taken with Vitamin C as same becomes poisonous if taken with Vitamin C.
In consideration of the fact that this case was filed in 2008 and that it has been in court for nine years, costs of N2 million is awarded against NAFDAC. Interest shall be paid on the costs awarded at the rate of 10% per annum until liquidation of the said sum.”

The position is the 32-year-old actress’s first political appointment in her home state.
A statement by the Secretary to the State Government, Ayoade Arike, said the appointments will be effective from April 1.
Mrs. Arike said the appointments are to “plug identified gaps in service delivery, fill key positions with the right people and to broaden inclusiveness in governance by bringing people from more communities on board.”
According to the statement, in addition to the 54 Senior Special Assistants appointed, nine Special Assistants to the Governor as Federal Constituency Supervisors for the GYB Connect Programme have also been approved.
The statement said the appointment was to recognise and encourage outstanding contributions to the New Direction Agenda.
The statement added that the nine Special Assistants would also act as direct liaisons between the present administration and the Local Government Ward Coordinators of the GYB Connect Programme.
Mercy, who charges as much as N2 million to star in a movie, auditioned for her first movie role in The Maid in 2004, right after completing her secondary school education.

The Standards Organisation of Nigeria has arrested a cosmetics and wine importer suspected of changing the expiry dates on products and putting new dates on them to mislead buyers, Punchng is reporting.
The importer, Mr. Joseph Udeh, owner of Jouf Nigeria Limited, located at No. 10 Faith Street, off Comfort Oboh Street, Kirikiri Road, Apapa, Lagos, is said to be a major dealer in popular cosmetics and home product brands. .
He converted two four-storey residential buildings, each containing eight rooms into storage facilities for products. A closer look at some of the cosmetics revealed varying expiry dates, some dating as far back as 2004 while some had expired in 2013 and some in 2016. .
Udeh whose shop is located at Balogun Market, Trade Fair complex, said he was a supplier to major retail outlets and some of the major department stores in Nigeria. .
Addressing journalists shortly after the operation, the Head, Inspectorate and Compliance, SON, Mr. , said the importer would face the full wrath of the law. .
“The volume of the goods that expired is inestimable. Imagine a product that should be used in wrapping up a baby in 2017 has expired in 2015, what will be the effect on the baby, of course it would be negative reaction on the baby. .
We have baby powders that have expired since 2013 and four years after, the products are still going into the market. When they sell, they remove the expiry dates and put new dates to deceive the unsuspecting consumers and when you buy these products, you think they are products that can help you, not knowing that they are products that would cause you all sorts of diseases.” .
According to the SON official, many innocent people suffer without knowing the root causes of their illnesses, maintaining that the importer of these expired products are killing and robbing innocent Nigerians of their hard-earned money.
